El Paso, TX — Tomorrow is Election Day for the November 2024 General Election and we want to remind all voters about important regulations to ensure a smooth and fair voting process.
No Cell Phones Allowed: Under Texas Election Code, Section 61.014(a), wireless communication devices used to record sound or images may not be used within 100 feet of a voting station at a polling site. This includes cell phones, cameras and tablets. The Presiding Judge has the authority to require persons to deactivate any such device and to require persons who do not comply to leave the polling site.
Exceptions:
- Election Workers while acting in their official duties. This does not include Poll Watchers.
- Persons using assistive technology devices. At the discretion of an Election Judge.
- Persons employed at the polling site, while acting in course of person’s employment.
Electioneering Apparel Not Permitted: Texas Election Code, Sections 61.003, 85.036, and 61.010 have all been upheld as constitutional and apply to the prohibition of electioneering which includes the wearing of apparel related to a candidate, measure or political party, whether on or off the ballot. Please do not wear shirts, hats, or any apparel to a polling site that communicates something for or against any candidate, measure, or political party. Electioneering, which includes wearing anything for or against any candidate, measure or political party inside the 100-foot area of a polling site, is against the law. This is regardless of whether a candidate is or is not on the ballot. A violation of this is a Class C misdemeanor.
